Statement of Indian Law (2 Vols.) - 1st Edition 2016 by Govind Goel
The Supreme Court of India succeeded to thejurisdictionof the Federal Court and the Judicial Committee. At the inaugural sitting of the Supreme Court of India on 28th January, 1950, the first Attorney General of India, Mr. M.C. Setalvad, in his address, referring to the extent and nature of the jurisdiction of the Supreme Court said "the jurisdiction and powers of this Court, in the nature of extent, arewider than those exercised by the highest Court of any country in the Commonwealth or by the Supreme Court of the United States." He analysed the task before the Court and said "your foremost task will be to interpret the Constitution which is but a means of ordering the life of a progressive people. The Federal Court has already laid down that a Constitution is to be interpreted in no narrow spirit". The First Chief Justice of India, Justice H,J. Kania in his response said "The Constitution of India.... has tried to provide for various contingencies, which can be reasonably thought of....... different parts of the Constitution will act and react on each other and the Court will have to decide questions arising from such a situation. He further observed that "this Court will be called upon to discharge its duties as perhaps no other Court has so far been called upon to do. " The Chief Justice went on to say that "the Supreme Court would declare and interpret the law of the land in 'no spirit of formal or barren legalism ".
